Iowa's current statute for School Bus Stop Arm Violation:
$200 fine 
Kadyn's Family in collaboration with Kim Koenigs and Lori Arnold of "Nathan's Law" (Mississippi, Washington, New Hampshire, West Virginia) propose "Kadyns Law".

"Kadyns Law"
 
(School Bus Stop Arm Violation)

 Fines:

1st offense- Not less than $350 and no more than $750 and/or a year in jail.

2nd offense- (in a 5 year period of time)- fine of $750-$1,500 and/or up to a year in prison, suspension of license for 90 days.

3rd Offense- (in a 5 year period of time) Class  D  felony to include jail time.   Fine of $750-$7500 and/or 5 years in jail suspension of license for 180 days. 

 

Serious Injury By Vehicle-If a pedestrian is injured by someone overtaking a stopped school bus with the stop sign out and lights flashing, it would be a MANDATORY 5 years in jail, no probation, fine of $750-$7500,32% surcharge, court costs, $125 law enforcement surcharge, $100 to public service bus safety surcharge, restitution to injured person, 1 year license suspension. This is usually used for injury of person while driver is intoxicated.  Overtaking a school bus would be added.

Vehicular Homicide 1-If a pedestrian is killed by a driver overtaking a stopped school bus with the stop sign out and lights flashing, where NO drugs are found in the driver’s system, it would be a MANDATORY 15 years in jail, no probation, fine of $2,500-$10,000, 32% surcharge, court costs, $125 law enforcement surcharge, court costs,$100 to public service bus safety surcharge, restitution to victim’s estate, 4 year license suspension.

 

Vehicular Homicide 2- If a pedestrian is killed by a driver overtaking a stopped school bus with the stop sign out and lights flashing and ANY illegal drugs are found in the driver’s system, it would be a MANDATORY 25 years in jail, no probation, fine of $10,000, 32% surcharge, court costs, $125 Law enforcement surcharge, $100 to public service bus safety surcharge, $150,000 to victim’s estate, 6 year license suspension.

OTHER ADDITIONS:
    1. Bus safety curriculum added for grades k-3
    2. Aids on every bus
    3. Community Service to include being a bus aid
    4. Special needs children having bus aids as part of their IEP
    5. Camera system on each bus using the “Alert Star” model and a 33,33,33 percent breakdown to pay for the cameras. 
      • Fines can go towards cameras such as in the states of Washington, Georgia, and Maryland.  
      • The license plate number is obtained and it is the owner of the vehicle who is prosecuted unless they can prove who was driving their car. 
    6. Bus radio channel on same channel as the county to expedite response time in case of emergency
    7. Questions on Driver’s license exam pertaining to school stop arm rules. 
    8. Ban on using electronic devices in school zones and crossing areas
    9. Ban on bus drivers using electronic devices while operating school buses.
    10. Bus driver’s required to be trained in First Aid and CPR. 
 
 
  
 
This law is meant to Honor Kadyn, Love Kadyn and CHANGE the state of Iowa in her name so all of our littles will be more safe.

"In 28 states throughout the country, school bus drivers recorded in a one-day snapshot how many times other motorists passed their school buses illegally while the buses were stopped displaying their flashing red lights and stop arms. Almost 112,000 bus drivers reported 37,756 total stop arm passing incidents, often involving several cars in each incident. Reports were not available from all states, but in a typical 180-day school year, the 76,685 vehicles that passed school buses illegally represent well over 13 million violations by private motorists."
That is potentially 37,756 dead children EACH DAY in the US!!
